Conversion: Constitutional and Legal Implications

Anurag Sharma (Author) Faizan Mustafa (Author)
Synopsis Conversion is one of the most emotional issue in India. In recent years the religious freedom and rights of minorities have been in news. The electoral politics and communal riots in Gujrat have created a fear amongst the minorities. Conversion is not only a religious or political issue but at the same time, it has vital societal and legal implications as well. It is really shocking that such a crucial area has not been investigated objectively and rationally. The book in hand is a humble attempt to fill this gap. It deals with the meaning and significance of conversion under various religions. It examines the attitude of religions towards conversion as well as renunciation of religion or apostasy. It also makes an indepth analysis of anthropolical reasons and other factors which prompt a person to adopt another religion. The book discusses the freedom of religion under Indian constitution. It examines relevant articles and judicial pronouncements on the subject critically and objectively. The book also evaluates the debate as to the causes and benefits of conversion. There are several myths on this issue and many hard facts have been deliberately brushed aside in the earlier writings on the subject. An attempt is made to rationalize the whole debate. Christian missionaries have been targeted for their role in conversion. The book discusses their role and contribution to Indian social reform movement at length. The book also examines the legality of various Anti-Conversion laws. The apex court’s pronouncement on this issue has received special attention. The book presents a detailed analysis of legal implications involved in a conversion. Both Hindu and Muslim laws have been discussed in detail. The contradictions in judicial pronouncements have been highlighted at length. The issue of re-conversion has also been examined in all its dimensions. Finally broad conclusions and suggestions are discussed.
