Naradasmrti: Historical, Sociological, Political and Legal Study

Sunanda Y. Shastri (Author)
Synopsis Naradasmrti-a text of Circa 2nd or 3rd century A.D. occupies an unique place among the ancient Hindu law books. Usually, the Smrti texts deal with Acara (code of conduct); V yavahara (Law) and Prayascitta (espiation). Naradasmrti is the only ancient law text, which is exclusively devoted to Vyavahara. It deals with civil and criminal laws and judicial procedure. It evolved its own arrangement of titles of law and made original contribution to the field of ancient law. The written law in all probability known as the court of law comes to its real Supreme status in this work of Narada. Another special feature of this text is, it is liberal in handling the rights and freedom of women. It allows women to have divorce, nullification of marriage, and rights of inheritance. Naradasmrti’s popularity and authenticity in the contemporary period is revealed by the fact that more than seven hundred verses out of one thousand and twenty-eight verses of this text are found quoted by different authors and commentators of Smrti literature. This important epoch-making law text, till today has not received much attention from modern Indian and Occidental Scholars, which it really deserves. Its importance and original contribution to Civil and Criminal law is not widely known. The main aim of this work is to bring out Naradasmrti’s significant contribution made to civil and criminal law of ancient India, making indepth study of all its topics. Each topic of Naradasmrti is studied here in comparison with Manusmrti and Yajnavalkya-smrti.
