Indian Legal System

S.P. Sharma (Author)
Synopsis Besides being informative and educative, the present book is intended to be an infrastructure for resurrection of the system which continues to be the kind of a ladder for feudalistic aspirations. Unfortunately so far as the Indian Legal System is concerned we are being governed by the British still after over four decades of freedom. This aspect of the legal system has been very well dealt with. The defects in the process of judicial appointments have been studied scientifically and the need for brevity in the judicial process has been highlighted. The need for humanizing the law and transformation of the process of justice have been adjudged to be the most important essentials of the legal system. The problem of arrears of pending cases which has constrained at least a couple of Chief Justices of India to say that the judicial system was on the verge of collapse, has been examined closely to the outcome that in case we adopt an Indianised Legal System, the problem of pendency would evaporate in the thin air and the judges would wait for cases not to talk of the backlog. Towards this end the need for total transformation of the administrative process has been brought about. The book seeks to conclude that India needs poor judges with rich experience of poverty to ensure dispensation of litigationless justice to the poverty stricken masses of people who constitute over seventy per cent people of India. Moreover, the endless shrieks for right and rights must be replaced by eagerness for duties.
